委托拓展培训合同

拓展活动培训单位:深圳市假日旅行社有限公司 (以下简称甲方)

委托拓展培训单位:________________________ (以下简称乙方)

    为保证拓展训练的顺利进行,确保参加拓展训练人员的活动质量,甲、乙双方就明确双方的责任达成如下协议:
    一、甲方接受乙方委托,并于协定时间以户外培训形式接待乙方的培训人员。时间:_______年_______月_______日至_________年_______月_______日,费用为_________/人,其中包含____________________________________,不含_____________________________。人数为______人,合计金额为:_________________________。
    二、培训课程安排表由甲、乙双方协商确定(培训课程安排表见附件),如在培训活动中甲、乙任何一方对培训活动有变更请求的,则必须征得另一方同意,否则,甲、乙双方必须按原定培训课程安排表进行培训活动。
    三、甲方的义务:
        1、甲方负责提供培训的场地;
        2、甲方负责提供导师指导培训课程;
        3、甲方负责提供相应的培训训练基地责任保险;
        4、甲方负责乙方团队食宿安排、卫生保障,安全防范与指导、简单医疗急救措施服务。
    四、乙方的义务:
        1、乙方承担培训活动的课程及食宿费用的支付。
        2、乙方必须严格遵循培训课程表的安排来进行,并保证配合甲方培训课程期间的相关安全措施;
        3、乙方必须在培训课程进行时严格按甲方的安全标准来进行活动;
        4、乙方必须严格遵照甲方培训场内规定,不能破坏场内设施;
        5、乙方不能在培训场内传播宗教信仰及进行传销活动;
        6、乙方不能在雷电之下活动。
    五、培训费的支付:
        1、为了能让课程顺利进行及能有充分时间进行课程准备,乙方必须在培训课程进行前7天,将培训总费用的30%的定金直接存入甲方指定的银行帐号或以现金支付予甲方,否则,甲方可单方解除本合同而无须通知乙方。
        2、乙方必须于接受培训课程当日前,将余款(培训总费用的70%)直接以现金或支票支付予甲方。但支票必需到甲方帐上。

    六、违约责任:
        1、 培训课程进行时如乙方已严格遵守甲方所提供要求之安全指引,但仍然导致发生意外,则甲方将承担所导致的一切责任;反之,如乙方未能遵守甲方所提供的安全指引,所导致发生意外,则甲方将不承担所导致的一切责任。
        2、 如乙方逾期支付培训费的,则每逾期一日,须向甲方支付每千分之二的逾期付款违约金。
        3、 如乙方在培训过程中损坏培训场内设施的,必须给予甲方相应的赔偿。
    七、其他
        1、乙方确认_____________为履行本合同的全权代理人,该等代理人因本合同相关事宜所签收、签发的所有文件资料,乙方均予承认。
        2、本合同一式两份,甲、乙双方各执一份,自双方签字、盖章之日起生效。
